The Foreclosure Timeline

What is the timeline for foreclosure proceedings?

The timeline for foreclosure proceedings can vary depending on several factors.  Chief among these is whether or not you possess a Cape Coral foreclosure attorney to provide you with legal defense in your case.  If you are representing yourself in your foreclosure proceedings, then the process may take roughly six months following your mortgage default.  Hiring an experienced attorney may extend the process by up to four years, and give you the time necessary to find an alternative that may result in you and your family being able to stay in your home.

Once you start to fall behind on your mortgage payments, the timeline leading to foreclosure begins.  In purchasing your home, you signed two key documents: one a promise to make your monthly payments on time and in their full amount, and the other a mortgage that clearly states that the home is security for the loan.  This second document is what lenders employ in attempting to take possession of your home in a foreclosure.  A notice of default is sent to you after you fail to make your payments.  Not long after this, you will receive a notice of summons and complaint, which is a lawsuit filed by your lender.  You will have 20 days to respond to this, and it is crucial that a proper response is made.  If you do not respond, the case will go to court, and you will lose your opportunity to fight for the ability to stay in your home.  Hiring a lawyer in order to assist you with the defense of your case can make a very significant difference.
