The Foreclosure Process

An Overview of the Foreclosure Process

The foreclosure of a home is a multifaceted process than can be lengthy in its execution, as well as expensive.  If you are facing home foreclosure, then it is strongly advised that you contact an experienced Cape Coral foreclosure lawyer as soon as possible.  My name is Rex Powell, and I am an attorney that has provided foreclosure defense services to countless individuals throughout the Cape Coral area.  I am able to help homeowners pursue foreclosure alternatives such as short sales, loan modifications, and deeds in lieu, and I fight aggressively to maximize my clients' chances of an outcome that sees them retain the ability to stay in their homes.  Contact my offices today about your foreclosure case, and I will consult with you in order to devise a legal strategy that is optimized for your particular circumstances.

The foreclosure process in our state begins when a lender files a foreclosure lawsuit against a property owner.  The owner is served with a foreclosure complaint and a summons, and is given 20 days to respond to the lawsuit, or dispute it in some way.  If no response is given within that time frame, the lender is given the ability to motion for a default to be entered.  Should the homeowner respond, then the case goes to a court, where a judge decides whether or not a foreclosure is justified.  In the event that the court finds in favor of the lender, a foreclosure sale is scheduled, and the home is sold on that date.
