The TCPA, or Telephone Consumer Protection Act, is a piece of legislation that regulates commercial solicitation calls made to residences and cell phones. Some of the primary rules included in the act dictate that callers must:
- Only make calls between the hours of 8 am and 9 pm
- Maintain a "do not call" list that is strictly adhered to, and honor any requests by individuals who do not wish to be called again
- Maintain a clear and enforced training program for the personnel making the phone calls
- Maintain a clearly written "call policy" that is able to be viewed by anyone upon request
- Forward all "do not call" lists to the company being served, if the calling entity is a service bureau
