Cape Coral Repeat Violence Attorney

Helping Clients Involved in Cases of Repeat Violence

Repeat violence injunctions are covered in 2009 Florida Statute, Title XLVI, Chapter 784. Violence is defined there as "any assault, aggravated assault, aggravated battery, sexual assault, sexual battery, stalking, aggravated stalking, kidnapping, or false imprisonment, or any criminal offense resulting in physical injury or death, by a person against any other person. Repeat violence means two incidents of violence or stalking committed by the respondent, one of which must have been within 6 months of the filing of the petition, which are directed against the petitioner or the petitioner's immediate family."

Repeat Violence injunctions are intended to be used by individuals who are not in a domestic or relationship situation with the abuser.  Anyone who has been the victim of repeat violence may file for a Petition for Injunction against Repeat Violence, if the abuser has committed at least 2 acts of violence or stalking against you or an immediate family member and one of the 2 acts has occurred within the last 6 months. The Injunction will contain an order for the abuser to stop the abuse immediately. It may also order the abuser to vacate the residence you share, prohibit him from making contact with you at your home, work, or school, and/or to attend a batterer's intervention or get appropriate counseling.
