FDCPA - Fair Debt Collection Practices Act

Has your lender violated FDCPA law in attempting to collect mortgage payments?

The Fair Debt Collection Practices Act (FDCPA) is a set of laws that govern the practices of lenders and third party collection agencies that are seeking to recover a debt.  Specifically, it is meant to protect consumers from harassing or abusing tactics that may be employed by those intent on recovering money that they are owed.  Some of the primary rules contained in the act dictate that a creditor cannot:

  • Attempt to contact a debtor by telephone between the hours of 9 pm to 8 am
  • Call a debtor repeatedly in order to harass or frighten them
  • Threaten legal action against a debtor if the creditor does not actually intend to take this action
  • Use profane or abusive language when speaking to a debtor
  • Threaten a debtor with arrest at any point
  • Call a debtor at their place of work, after their employer has expressly forbidden creditors to do so
  • Contact family members or associates of the debtor in an attempt to collect on a debt
