FCCPA - Florida Consumer Collection Practices Act
What is the FCCPA?
The Fair Debt Collection Practices Act, or FDCPA, is a set of rules that exists at the federal level in order to regulate the behavior of entities who are seeking to collect debts, such as banks and other home loan lenders. Our state has taken this a step further by enacting its own legislation, referred to as the Florida Consumer Collection Practices Act, or FCCPA. Aside from dictating what creditors can and cannot do in their attempts to collect debts, this act also mandates that collection agencies must register with the state before initiating collection activities. Some of the rules that exist in this act forbid a collection entity from:
- Engaging in communication with a debtor or their family to the extent that it becomes harassing or abusive
- Using profane or vulgar language when communicating with a debtor or their family
- Attempt to communicate with the debtor between the hours of 9 pm and 8 am without first obtaining their consent
- Use, or threaten, arrest, force, or violence
