Cape Coral Debtor's Rights Attorney

Assisting Clients in Cape Coral, Ft. Myers, Bonita Springs, Lehigh Acres, and Surrounding Florida Counties

Do you need legal assistance with any debtor's rights matters in the Cape Coral area? As a consumer, are you aware of state and federal laws which protect you, such as the Fair Debt Collection Practices Act? If you are being harassed by a collection agency or other creditor, your legal rights may have been violated. If so, you may want to seek the legal services of a Cape Coral debtor's rights lawyer, such as myself, who aggressively fights for the rights of consumers and borrowers throughout the Florida counties of Lee, Collier, and Charlotte.

Debt Collectors

If you've lost your job, or have been forced to take a pay cut, there is a good chance that you have fallen behind on a credit card, car, or mortgage payment. While the original lender may call you and make collection attempts for a short period of time, eventually a debt that is in default will likely be sold to a debt collector.

In general, debt collectors will aggressively pursue you in order to collect a debt. Fortunately, there are several Federal and State consumer protection statutes in place which control what a debt collector may or may not do. For instance, did you know that a debt collector may only call you between the hours of 8:00 am and 9:00 pm? Moreover, a debt collector may not harass a debtor by making repeated phone calls in a short period of time. These specific rules regarding telephonic contact are only the tip of the iceberg.

Here is a short list of some of activities prohibited by Federal law:

•A debt collector must cease communication with you if you make such a written request (with certain very limited exceptions);
•A debt collector may not contact you at your place of employment after you have advised the collector that you do not wish such contact, or that such contact is prohibited at your place of employment;
•A debt collector may never threaten arrest, and may only threaten legal action if there is an actual intent to pursue a lawsuit;
•A debt collector may never discuss the existence or details of a debt with a third party;
•A debt collector may not use profane or abusive language when communicating with a debtor.

Unfortunately, despite the existence of the Fair Debt Collection Practices Act, and despite the fact that statutory penalties exist for violation of most consumer protection statutes, many debtors may find themselves the victim of inappropriate and potentially illegal conduct at the hands of debt collectors. If you have been victimized by inappropriate and abusive conduct at the hands of a debt collector, contact me for a free consultation. I will take the fight right to the debt collector's door step.
